9月26日，在短視頻平臺擁有約50萬粉絲的博主“Lida不是力氣大”的賬號被無限期封禁，1200多個作品被清空。

The account of social media influencer Lida is Not Strong was permanently banned from a major short-video platform on Friday. More than 1,200 posts were removed, and her account — once followed by around 500,000 users — was shut down indefinitely.

該博主被舉報涉嫌非法推薦股票，在粉絲群賣課，引導(dǎo)粉絲進(jìn)行股票買賣和理財。

The influencer, surnamed Han, was accused of illegally promoting stocks, selling paid investment courses in private fan groups, and encouraging followers to engage in stock trading.

今年5月初，該博主發(fā)布其在貴州旅游的視頻，她稱“這是一條旅游避雷貼”。

視頻中她提到五一假期人多等問題，被網(wǎng)友質(zhì)疑是抹黑貴州文旅。該視頻引發(fā)全網(wǎng)熱議，網(wǎng)友稱這位博主為“避雷姐”。

據(jù)貴州廣播電視臺百姓關(guān)注報道，貴州一策律師事務(wù)所的邵帥律師向記者反映，接到網(wǎng)紅“避雷姐”韓某粉絲的咨詢，粉絲稱韓某在粉絲群內(nèi)引導(dǎo)大家購買課程，想確認(rèn)其是否具備相關(guān)資質(zhì)。

邵律師與團(tuán)隊展開調(diào)查取證，發(fā)現(xiàn)韓某看似在網(wǎng)上“熱心分享”，實(shí)則背后暗藏諸多疑點(diǎn)。

律師團(tuán)隊在取證過程中發(fā)現(xiàn)，該博主韓某不僅開展證券投資咨詢服務(wù)，還通過預(yù)測股市行情，開設(shè)“搞錢分享課程”，為粉絲提供股票購買建議。韓某甚至在開播時，帶領(lǐng)粉絲去進(jìn)行股票的買入。

According to Shao Shuai, a lawyer with a Guizhou-based law firm, several fans sought legal advice after Han began selling her investment courses. Shao's team found that behind her so-called "financial tips", Han was actually providing unauthorized securities consulting, predicting market trends, selling "money-making courses", and even directing followers to buy specific stocks during live streams.

根據(jù)《中華人民共和國證券法》規(guī)定，未經(jīng)過中國證監(jiān)會的許可，任何的機(jī)構(gòu)以及個人，不得從事證券投資咨詢業(yè)務(wù)，該博主的行為涉嫌違法。

China's Securities Law prohibits individuals or institutions from offering securities investment consulting without approval from the China Securities Regulatory Commission. Han's activities were allegedly in violation of these regulations.

在進(jìn)一步調(diào)查中發(fā)現(xiàn)，韓某戶籍和辦公地址都在上海，卻將一個“空殼”工作室掛名在重慶。

目前，該工作室已被重慶市場監(jiān)督管理局列入“經(jīng)營異常名錄”。重慶證監(jiān)局也認(rèn)定韓某確實(shí)存在非法推薦股票的行為，并且對她出具了警示函。

Investigators also discovered that Han had registered a shell studio in Chongqing, despite being based in Shanghai. The entity was later flagged by local regulators.

韓某曾多次在公開平臺表示，自己做自媒體和投資，年入百萬，以此吸引粉絲聽從她的投資建議。

韓某近期還在粉絲群中表示自己已經(jīng)考取了證券從業(yè)資格證。

邵律師指出，并非是考取了這個證就可以做相應(yīng)的投資業(yè)務(wù)。證券從業(yè)資格證書是從事證券業(yè)務(wù)的基礎(chǔ)證書，涵蓋證券市場基礎(chǔ)、法律法規(guī)及業(yè)務(wù)流程，是進(jìn)入證券行業(yè)的入門要求，而合法開展薦股、診股等投資咨詢服務(wù)，需要取得證券投資顧問資格證，并且禁止代理客戶操作。

Han frequently boasted that her media and investment ventures brought in millions annually, using such claims to build followers' trust.

She recently told fans she had obtained a professional license, but Shao noted that the qualification only permits entry into the industry. Legally providing stock recommendations requires a higher-level license, and managing trades on behalf of clients is strictly prohibited.
