喝酒不開車，開車不喝酒，是一條駕駛“鐵律”。然而智駕技術(shù)發(fā)展迅速，有人心里生出一絲僥幸。近日，浙江杭州一男子就因為酒后使用一款“智駕神器”駕車而被判危險駕駛罪。

A man in Hangzhou, Zhejiang province, was recently convicted of dangerous driving for operating a vehicle while using a so-called "smart driving device" under the influence of alcohol.

9月26日，浙江杭州“臨平檢察”披露的一起案件，引發(fā)關(guān)注。

據(jù)了解，9月13日凌晨2時許，浙江杭州，一輛打著雙閃燈的小客車靜靜停在道路中央，阻攔后方車輛通行。過路群眾發(fā)現(xiàn)異常前來查看，發(fā)現(xiàn)該車輛主駕駛位空著，僅有副駕駛座上躺著一名男子，車內(nèi)中控臺還顯示著“報警”提示，便報了警。

According to reports, on Sept 13 around 2 am, a stationary vehicle with its hazard lights on was found on a road in Hangzhou, Zhejiang province, blocking the path and preventing vehicles behind from passing. A group passing by noticed the abnormality and approached to investigate, discovering no one in the driver’s seat, with only a man lying in the passenger seat. The vehicle’s central console displayed an "alert" warning, prompting the group to report the incident to police.

這一查，著實令人嚇出冷汗。

路面監(jiān)控畫面顯示，上述小客車的車主王某某于9月13日零點31分許從一處夜宵點駕車進入某小區(qū)，后于1點17分許又駕車離開小區(qū)。車輛后臺數(shù)據(jù)顯示，1點17分至18分，在車輛行駛過程中，王某某從主駕駛位挪到了副駕駛位。1點28分許，監(jiān)控畫面拍到車輛在高架橋上行駛，而王某某躺在副駕駛位酣睡的畫面。直至1點38分，車輛才自行停下、打開雙閃。

也就是說，該車輛在主駕駛位無人的情況下行駛了足足20分鐘。所幸夜深車少，未造成嚴重后果。

當(dāng)日凌晨3時11分，經(jīng)檢測，王某某血液中乙醇含量達114.5mg/100ml。到案后，王某某承認其于9月12日晚至次日凌晨與朋友吃夜宵，喝多了酒，因此抱著僥幸心理讓車輛自動駕駛。

為什么主駕駛位上無人，車輛還能自動駕駛？

Why could the vehicle drive autonomously with no one in the driver's seat?

王某某的這輛小客車是今年5月購買的，裝有2級智能輔助系統(tǒng)。按照車輛系統(tǒng)設(shè)定，駕駛車輛時，一旦雙手脫離方向盤、使用該輔助系統(tǒng)超過2分鐘，系統(tǒng)就會提示駕駛?cè)藛T接管方向盤，否則會主動降速并退出系統(tǒng)，以此確保行車安全。

The car, purchased in May of this year, was equipped with a Level 2 autonomous driving system. According to the system’s design, if the driver’s hands remain off the steering wheel for over two minutes while using the assisted driving feature, the system issues a warning to retake control. Failure to do so triggers automatic deceleration and system shutdown to ensure safety.

“該系統(tǒng)不允許駕駛員不在駕駛位操作，也不能代替駕駛員，系統(tǒng)簡介中是有文字警告的，駕駛員不可能不知道?！痹撥囕v銷售公司的技術(shù)專家表示。

然而，為了“騙過”方向盤檢測，王某某在方向盤上加裝了一種被稱為“智駕神器”的配件，讓系統(tǒng)誤以為駕駛?cè)藛T的雙手未脫離方向盤，使車輛持續(xù)保持無人駕駛的狀態(tài)。

檢察機關(guān)審查認為，王某某作為駕駛安全的第一責(zé)任人，在醉酒狀態(tài)下使用智能駕駛輔助系統(tǒng)在道路上行駛機動車的行為，已觸犯《中華人民共和國刑法》一百三十三條之一的規(guī)定，應(yīng)當(dāng)以危險駕駛罪追究其刑事責(zé)任。

Prosecutors concluded that the driver surnamed Wang, as the primary responsible party for driving safety, had violated Article 133 of the Criminal Law by operating a motor vehicle on public roads while intoxicated with the aid of an autonomous driving system, and should therefore be charged with the crime of dangerous driving.

9月17日，臨平區(qū)檢察院對被告人王某某依法提起公訴。綜合被告人王某某曾于2024年7月因酒后駕駛機動車被行政處罰的情節(jié)，9月19日，經(jīng)法院審理，被告人王某某被判犯危險駕駛罪，處拘役一個月十五日，并處罰金4000元。

On Sept 17, the people’s procuratorate of Linping district formally prosecuted Wang. Given his prior administrative penalty for drunk driving in July 2024, the court sentenced him on Sept 19 to one month and 15 days of detention, along with a fine of 4,000 yuan for the crime of dangerous driving.

潮新聞記者查詢電商平臺發(fā)現(xiàn)，目前，仍有不少商家正在售賣所謂“智駕神器”“智駕免打擾模塊”“智駕魔盒”等商品，且有的銷量過百。

記者以消費者身份咨詢一名商家，對方發(fā)來安裝視頻——只需將白色模塊接入方向盤內(nèi)部的插頭，即可實現(xiàn)安裝。

該商家發(fā)來的駕駛體驗視頻顯示，雙手離開方向盤能實現(xiàn)智能駕駛，“在狹窄和擁擠的城區(qū)道路也可以。”

“除了睡覺，都沒問題?！痹撋碳艺f。

法治日報報道，目前市面上絕大多數(shù)智能輔助駕駛系統(tǒng)仍處于L2級別，遠未達到可完全“托管”的程度。一旦駕駛員在開啟系統(tǒng)后放松警惕，甚至玩手機、睡覺，不僅違反道路交通安全法律法規(guī)，更對自身和公共安全構(gòu)成極大威脅。

新京報評論發(fā)文稱，“部分車主之所以購買、使用‘智駕神器’，既與某些車企銷售人員渲染輔助駕駛安全性能有關(guān)，也與‘智駕神器’商家忽悠有關(guān)。根據(jù)電子商務(wù)法規(guī)定，電子商務(wù)經(jīng)營者銷售的商品應(yīng)當(dāng)符合保障人身、財產(chǎn)安全的要求，而這種產(chǎn)品明顯違規(guī)?！?/p>

杭州市臨平區(qū)檢察院表示，后續(xù)將聯(lián)合相關(guān)部門，從技術(shù)端和市場端強化監(jiān)管，同時做好普法宣傳工作，提醒廣大消費者提高安全意識，規(guī)范安全駕駛。
